However, over the past two years, it has plunged headlong into what I’m calling The Lawless Era — a chaotic and transformative period in which the traditional rules governing amateurism, player movement, and institutional control have been effectively dismantled.

Driven by the rapid rise of Name, Image, and Likeness (NIL) deals, free player transfers, and a wave of legal challenges, this new age has upended the power balance across the NCAA landscape. Let’s break down how each of these forces has reshaped the game — and why this might only be the beginning.

The Rise (and Madness) of NIL Deals

What began as an overdue effort to let players profit from their own likeness has rapidly spiraled into an unregulated arms race.

• Recruiting Wars Monetized: High school and portal recruits are now fielding offers that include six- and even seven-figure promises tied to NIL collectives. Schools with the wealthiest donor bases — such as Texas, USC, and Michigan — have seen a surge in recruiting due to their NIL “war chests.”
• Quasi-Salary Systems: Although technically not “pay-for-play,” many NIL deals functionally operate as salaries. Starting quarterbacks at top programs can now earn more than NFL rookies.
• Disparity and Locker Room Tension: Unequal NIL distribution can lead to internal fractures. When one freshman is driving a Lamborghini and a team captain is on a basic deal, cohesion suffers. Clearly, some recruiters will point out those differences when engaging in illegal solicitation of a transfer.
• The Booster Takeover: Boosters and third-party collectives now wield unprecedented influence over roster building and coaching decisions — essentially becoming shadow GMs in some cases.

A New Age of Free Agency

Since the NCAA was forced to drop the requirement to sit out a year following a first-time transfer, the transfer portal has exploded into a full-blown offseason spectacle.

• Rosters in Flux: Teams are turning over 30–40% of their rosters each year. What was once a redshirt developmental pipeline is now a revolving door of plug-and-play talent.

• The Fall of NCAA Authority: Legal decisions have declared the NCAA’s old amateurism model outdated and, in some cases, illegal. Now, the NCAA is operating from a position of fear — hesitant to enforce any rules, and unable to persuade Congress to bail it out with an antitrust exemption..
• Antitrust Attacks: The NCAA’s efforts to impose caps or regulate NIL deals have been repeatedly blocked by courts. Legal precedent now strongly favors player freedom and open markets.
• Title IX Ripple Effects: Lawsuits are emerging over gender equity in NIL opportunities and athletic department spending, potentially expanding The Lawless Era beyond football.

Winners, Losers, and What Comes Next

Winners:

• Elite players, who now earn life-changing money before going pro.
• Blue-blood programs with massive donor backing.
• Agents, attorneys, and marketing reps are making a killing.

Losers:

• Mid-tier programs that are losing top players with no leverage.
• Traditionalists hoping for a return to the old college model.
• Coaches, who are now operating in perpetual chaos with no off-season.

The Lawless Era has revealed one thing: college football was never truly amateur. The current model is messy, inconsistent, and unsustainable — but also more honest than ever before. What’s missing is regulation that strikes a balance between fairness and freedom.

Whether that comes via a players’ union, a new governing body, or a complete professionalization of major programs, one thing is clear: the days of the NCAA as the rulemaker are over. In its place is a new system — one where money, mobility, and legal muscle reign supreme.

Welcome to The Lawless Era. The game has changed — for good. However, the same old remedies that have been around since the beginning, such as congressional actions that exempt college football from antitrust laws, much like MLB enjoys, or the Power 5 schools can leave the NCAA and form a new governing body. The latter would exempt the new league from successful antitrust suits, as the “trust” (i.e., the NCAA ruling all 1,200 or so schools playing college sports) would no longer exist.
